Items Requiring Administrative Approval for Employment of Foreigners in Kunshan

1. Legal Basis:

The legal basis for this document is RULES FOR THE ADMINISTRATION OF EMPLOYMENT OF FOREIGNERS IN CHINA, which was jointly promulgated by the Ministry of Labor, Ministry of Public Security, Ministry of Foreign Affairs and the Ministry of Foreign Trade and Economic Cooperation of the People's Republic of China in 1996. L.B.F.(1996) No.29

2. Procedure:

Filling in Forms→Getting Preapproved→Receiving the License/Certificate

3. Material:

Documents Required for Application

1) three copies of the Application Form for Foreigner's Employment in China (filled in by the employer);

2) a report on the reason(s) for hiring the applicant (given by the employer);

3) an employment document (provided by the employer, such as offer letter, letter of appointment, or any other similar decision);

4) proof of education and work experience of the applicant (provided by relevant foreign institutions or organizations or the applicant himself/herself, stamped by the employer);

5) proof of the applicant's qualifications for the job (including his/her education background, skills and at least two years of work experience in the relevant field. The original copies, together with the translated versions of aforesaid documents provided by professional language service providers, shall be submitted);

6) proof of the applicant's health conditions (of the most recent six months);

7) No Criminal Record Certificate (issued by the Chinese embassy or consulate or police authorities in the home country of the applicant in the most recent six months);

8) a photocopy of the applicant's passport;

9) photocopies of the approval certificate (if it is a foreign-invested enterprise) or the business license (if it is a Chinese enterprise) as well as the organizational code certificate; and

10) the pre-approval form for Kunshan Employment Permit for Foreigners obtained by the applicant from the local bureau of labor and social security.

4. To apply for a Foreigner's Employment Certificate, the applicant needs to submit the valid documents as listed below:

1) three copies of the Employment Registration Form of Foreign Employees in China (filled in by the employer);

2) a photocopy of the Employment Permit for Foreigners of the People's Republic of China;

3) the labor contract signed between the employer and the applicant (not necessarily signed by the legal representative of the employer);

4) the original and photocopies of the applicant's passport and Z visa;

5) the original and photocopies of the health certificate issued or confirmed by the Entry-Exit Inspection and Quarantine Bureau;

6) the residence registration certificate issued by the local police authorities;

7) four pieces of two-inch ID photos (recently taken, no hats); and

8) the pre-approval form for Kunshan Employment Permit for Foreigners obtained by the applicant from the local bureau of labor and social security.

5. To apply for extension or renewal of the Employment Certificate, the applicant shall submit the valid documents listed as below:

1) three copies of the Application for Extension of Employment (filled in by the employer);

2) the original and photocopy of Foreigner's Employment Certificate;

3) photocopies of the applicant's passport and residence visa;

4) the employment contract signed between the employer and the applicant;

5) photocopies of the approval certificate (if it is a foreign-invested enterprise) or the business license(if it is a Chinese enterprise) as well as the organizational code certificate of the employer; and

6) the pre-approval form for Kunshan Employment Permit for Foreigners obtained by the applicant from the local bureau of labor and social security.

General Procedure for Applying for Foreigner's Employment Certificate

1. Obtain an Employment Permit for Foreigners of the People's Republic of China from human resources and social security authorities;

2. Apply to foreign affairs authorities for the invitation letter for Z visa;

3. Apply for the Z visa at the Chinese embassy or consulate in the applicant's home country;

4. Apply for a Foreigner's Employment Certificate to human resources and social security authorities within 15 days after entering China; and

5. Obtain a Residence Permit from police authorities within 30 days after entering China.

6. Committed deadline:All applications and procedures will be addressed immediately.

7.Transaction with charges:The charge is collected on behalf of Jiangsu Job Agency Center

8. Amount of charge:RMB 50 per month
